Terms of Service

The terms and conditions governing your use of Bumgandu.

Last updated: 15 October 2026

These Terms of Service ("Terms") govern your access to and use of the Bumgandu platform, including the Bumgandu iOS administration app, the customer ordering app on iOS and in the browser, and this website (together, the "Service"). The Service is provided by Bumgandu Ltd ("Bumgandu", "we", "us"). By using the Service you agree to these Terms.

1. Who these Terms apply to

"Restaurant" means a business that uses the Service to manage its menu, orders and payments. "Diner" means a person who uses the customer app or web app to browse a menu and place an order with a Restaurant.

If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.

2. The Service

Bumgandu provides software that lets Restaurants publish menus, receive orders and take payment, and lets Diners place and pay for orders. Bumgandu is a technology provider. We are not the seller of food or drink, and the contract for any order is between the Diner and the Restaurant.

We may update, improve or change the Service from time to time. We will try to give reasonable notice of changes that materially reduce the functionality you rely on.

3. Accounts and access

Restaurants must keep their login details confidential and are responsible for all activity under their account, including the actions of their staff. Tell us promptly at info@bumgandu.com if you suspect unauthorised access.

You must provide accurate information and keep it up to date. You must not share access with anyone who is not authorised to act for your business.

4. Restaurant responsibilities

Restaurants are responsible for the accuracy of everything they publish through the Service, including menu items, prices, descriptions, images and availability.

Restaurants must comply with all laws that apply to their business, including food safety, hygiene, licensing, consumer protection, tax, and allergen information requirements. Bumgandu does not verify allergen or dietary information and Restaurants must ensure it is correct and current.

Restaurants are responsible for fulfilling, and where appropriate refunding, the orders they receive.

5. Diners

Diners agree to provide accurate order details, such as the table number, and to pay for the orders they place. Questions about food, preparation, allergens, refunds or service should be directed to the Restaurant.

An order is submitted to the Restaurant once payment succeeds. Whether an order can be changed or cancelled after that point is decided by the Restaurant.

6. Payments

Card payments are processed by Stripe, a third-party payment provider. Card details are entered into Stripe's secure payment form and are not stored by Bumgandu. Use of Stripe is subject to Stripe's own terms and privacy policy.

Restaurants authorise us and Stripe to process payments on their behalf. Fees, if any, will be set out in the agreement or pricing you accepted when you signed up. Restaurants are responsible for any chargebacks, refunds and disputes relating to their orders.

7. Acceptable use

You must not use the Service to break the law, infringe the rights of others, upload harmful or misleading content, attempt to gain unauthorised access to the Service or its data, interfere with its operation, reverse engineer it, or use it to send spam or malware.

We may suspend access to the Service if we reasonably believe it is being misused or puts the Service or other users at risk.

8. Your content

Restaurants keep ownership of the content they upload, such as menus, images and logos. You grant Bumgandu a non-exclusive, worldwide licence to host, display and process that content solely to provide and improve the Service.

You confirm that you have the right to upload your content and that it does not infringe anyone else's rights.

9. Our intellectual property

The Service, including its software, design, trademarks and logos, belongs to Bumgandu or its licensors. These Terms do not transfer any ownership to you. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms.

10. Personal data

We handle personal data in line with our Privacy Policy. For personal data of Diners that a Restaurant receives through the Service, the Restaurant is responsible for using that data lawfully.

11. Availability and support

We aim to keep the Service available and working well, but we do not guarantee that it will be uninterrupted or error free. We may need to carry out maintenance, and the Service relies on third parties such as hosting, app store and payment providers that are outside our control.

Restaurants should have a fallback way to take orders if the Service is unavailable.

12. Disclaimers and limits on liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

Subject to that, the Service is provided "as is". We are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data. We are not responsible for the food, drink or service provided by Restaurants.

Subject to the first paragraph above, our total liability to you in connection with the Service in any 12-month period is limited to the amount you paid us for the Service in that period.

13. Indemnity

Restaurants will compensate Bumgandu for losses arising from claims by third parties relating to the Restaurant's content, products, food safety or breach of these Terms or applicable law.

14. Suspension and termination

You may stop using the Service at any time. Restaurants who want to close their account can contact us at info@bumgandu.com.

We may suspend or end your access if you materially breach these Terms or if we are required to by law. On termination, rights and obligations that by their nature should continue, such as those on payments, liability and intellectual property, will continue.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change we will take reasonable steps to tell you, for example by email or in the Service. The date at the top of this page shows when the Terms were last updated. Continuing to use the Service after a change means you accept the updated Terms.

16. Governing law

These Terms and any dispute or claim arising out of or in connection with them are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that a consumer living elsewhere in the UK may also bring proceedings in their local courts.
